Welcome to NELLE DEMESMAEKER. Unless explicitly agreed in writing, these Terms & Conditions apply to all offers and contracts between NELLE DEMESMAEKER and the Customer and govern your use of our Website and the purchase of Products from our Online Store. By accessing or using our Services, or by placing an Order, you agree to be bound by these Terms & Conditions, our Shipping Policy, our Refund Policy and by our Privacy Policy (NELLE DEMESMAEKER - Privacy Policy).

1. Who we are

NELLE DEMESMAEKER runs this Online Store and Website. Our Online Store is powered by Shopify, which provides the e-commerce platform used to operate our Online Store.

2. Definitions

The following definitions will apply to these Terms & Conditions, to our Shipping Policy, our Refund Policy and our Privacy Policy, regardless of whether they are used in the singular or plural.

- NELLE DEMESMAEKER: (de Rivierendreef 58, 1083 Ganshoren, CBE 0700.865.778), also designated as “we”, “us”, “our”, is the seller of the Products;

- Terms & Conditions: are these terms and conditions of NELLE DEMESMAEKER, adapted from time to time, that apply to all interactions with NELLE DEMESMAEKER, our Services, Orders, the use of our Website and Online Store. The Terms & Conditions also include the Shipping Policy, the Refund Policy and the Privacy Policy;

- Customer: any natural or legal person who enters into a contract with NELLE DEMESMAEKER regarding the purchase of Products, also designated as “you”;

- Website: www.nelledemesmaeker.be, including any and all pages on social media platforms used by NELLE DEMESMAEKER, such as, but not limited to Instagram and Facebook;

- Product: any good or item offered for sale by NELLE DEMESMAEKER;

- Online Store: the digital store, powered by Shopify and accessible by the Customer on the Website, through which NELLE DEMESMAEKER sells the Products;

- Services: include, but are not limited to, the offers and sale of the Products through the Website, Online Store and implementation of the Refund, Shipping and/or Privacy Policy;

- Order: the binding offer of the Customer via the Online Store to purchase one or more Products;

- Price: is the price of the Product, as advertised on the Website and in the Online Store;

- Force Majeure: an external, extraordinary, and unforeseeable event that cannot be prevented even with the utmost care on the part of the Party invoking it, such as natural disasters, fire, hostage situations, earthquakes, war, riots, terrorist attacks, floods, pandemics, or similar events;

- Intellectual Property: all patent, copyright, trademark, design and/or other (intellectual property) rights, including text, images, logos, designs, technical and/or commercial know-how, methods and concepts;

  • Parcel: the package containing the Product, including protective packaging and labelling, intended for shipment by NELLE DEMESMAEKER to the Customer

3. Orders & Acceptance

When you place an Order you make an offer to purchase the Products in your Order. An Order is accepted when we send you a confirmation email and process your payment. We may refuse or cancel any Order for any reason (for example, out of stock or suspected fraud). You alone are responsible for providing accurate order, billing and shipping information.

4. Prices & Payment

Prices are shown in euros (€) and include VAT unless otherwise stated. Shipping, duties and import taxes are not included in the Price, unless explicitly specified. We may change Prices or correct errors at any time. Payment must be made using the methods offered at checkout. By providing a payment method you represent that you are authorized to use it.

5. Shipping & Delivery

Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control, such as Force Majeure. Once your Products are handed to the carrier, the risk of loss or damage passes to you.

6. Returns & Exchanges

You may return your Products in accordance with our Refund Policy (NELLE DEMESMAEKER - Refund policy). In short:

  • EU consumers have a 14-day right of withdrawal from date of delivery; December orders get a 30-day return window.

  • Products must be returned unused, unworn, with original tags and packaging.

  • Some Products (sale items, personalised pieces) are non-returnable — see the Refund Policy for full details and return shipping fees.

7. Product Descriptions & Availability

We strive for accuracy but colours and appearance may vary with device settings. Product descriptions may be updated and we may discontinue products at any time. Quantities may be limited.

8. Intellectual Property

All Intellectual Property used by NELLE DEMESMAEKER on the Website, the Online Store and/or with regard to the Products, is owned or licensed by NELLE DEMESMAEKER and protected by copyright and trademark law. You may not reuse the Intellectual Property without our explicit prior written permission.

9. Limitation of Liability

To the fullest extent permitted by law, NELLE DEMESMAEKER’s liability for any claim arising from or relating to these Terms & Conditions, the Services, or any Products purchased is limited to the purchase Price of the relevant Product(s). We are not liable for indirect, incidental or consequential damages except where applicable consumer law provides otherwise (this does not affect your statutory rights).

10. Governing Law & Dispute Resolution

These Terms & Conditions are governed by Belgian law. Any dispute arising in connection with these Terms & Conditions will be subject to the exclusive jurisdiction of the courts of Brussels, Belgium, to the extent permitted by law.

11. Third-Party Services

We use third-party providers (including Shopify and payment processors) to provide our Services. These providers have their own terms and privacy practices which may apply to you. We are not responsible for third-party websites or services.

12. Changes to these Terms

NELLE DEMESMAEKER has the right to update  these Terms & Conditions occasionally at sole discretion. The current version will always be posted on our Website with the “Last updated” date. Material changes will be communicated to Customers as required by law.
